Rehabilitation of oustees main issue in dam height: SC
PTI
New Delhi, May 30

Saying that rehabilitaion of dam oustees was condition precendent to raising of the Sardar Sarovar Dam height, the Supreme Court on Thursday gave two days' time to Maharashtra, Gujarat, Madhya Pradesh and the Grievance Redressal Authority (GRA) to file affidavits regarding actual steps taken to rehabilitate the project affected families.

"We want to see whether rehabilitation of the dam oustees was carried out actually or just on paper," said a vacation Bench comprising Justice N Santosh Hegde and Justice SN Variava, while hearing a petition filed by Narmada Bachao Andolan (NBA) alleging that Narmada Control Authority (NCA) allowed raising of the height without proper rehabilitation.

While fixing further hearing of the matter on June 3, the Bench directed the three states and the GRA to file their affidavits by Saturday.

Appearing for the respondents, Solicitor General Harish Salve contended that the NCA gave the clearance for raising the height of the dam from 90 to 95 metres after getting clearance from Environmental sub-Group and the Relief and Rehabilitaion (R&R) sub-group as directed by the Supreme Court in its judgement dated October 28, 2000.

The Bench said as the petitioners alleged that proper relief and rehabilitation measures have not been carried out for those whose land and houses would be submerged on raising the height by five metres, "We have to satisfy ourselves about the measures taken by the authorites and governments in this regard."
